Maricopa County requires a minimum of one toilet per 100 people in attendance at a public gathering for a commercial, religious or public event, where the premises do not already provide adequate permanent facilities. Units must sit within 200 feet of the gathering. The county also allows existing off-site restrooms to count, but only with the owner's written permission, free public access for the whole event, and signs showing the way. On any Tempe event with real plumbed restrooms on site, that substitution rule is worth working through properly, because it can cut the order.
For a private party or a smaller function the county table may not engage, and a sound planning figure is one unit per 50 guests for about four hours, with 15 to 20 percent more where alcohol is served. The porta potty calculator runs that quickly.
Construction is where Tempe's number is firm. Maricopa County requires at least one sanitary toilet for every 20 people on a construction, alteration, repair or demolition project, placed on or within 200 feet of each work area. The federal three-tier table still sets the floor, and the Arizona Division of Occupational Safety and Health enforces it here, having adopted the federal standards by reference: one facility to 20 workers, one toilet seat and one urinal per 40 above that, and one per 50 at 200 workers or more.
One Tempe provision is worth naming so nobody misreads it. The city code has a section headed sanitary facilities, and it sits inside the rental housing standards. It governs what a rental dwelling must have plumbed in. It is not a rule about portable units and it does not restrict them.

Tempe is interesting because its two street instruments answer differently, and reading only one of them gives the wrong answer.
The first is a permit for using the public right-of-way, and it is a closed list. It bars anyone from erecting, maintaining or using any booth, stand, counter or vehicle on a public street, sidewalk, alley or other right-of-way for any purpose at all without a permit from the Financial Services Director. That permit only issues on the specific recommendation of both the Public Works Director and the Police Chief. A portable restroom is not a booth, a stand, a counter or a vehicle, so being absent from that list is the finding. The route was not drafted for us.
The second is the encroachment permit in the streets and sidewalks chapter, and that one is open-ended in the right direction. An encroachment permit may be issued for encroachments of a temporary and removable nature, and the code says that includes but is not limited to awnings and commercial signs. A longer-lived encroachment takes a license instead. The City Engineer sets the rules and procedures and decides which form applies, and a person aggrieved by the decision may appeal to the City Council.
A portable restroom is temporary and removable by nature, which is the language that fits. So the honest Tempe answer is that the encroachment permit is the route to ask about, not the booth and stand permit, and that the City Engineer makes the call. Get it in writing before you plan a unit on a Tempe street.
Tempe's own web host would not serve us while this was written, so the city code text is the authority here. The county layer belongs to Maricopa County Environmental Services, reachable on 602-506-6616, which publishes the Maricopa County Environmental Health Code. Tempe sites are tight, so placement is usually the first thing to settle. Units need level, firm ground and a straight approach for a service truck. Each permitted vehicle carries a county-assigned number on the cab doors and the rear of the tank, in letters at least three inches high. The county fixes the approved destination when it issues the permit, and that destination cannot change without its approval. Arizona adds a state septage hauler license through its environmental quality department, and its wording names a fixed or transportable chemical toilet. So your supplier's permits form part of your own compliance position, and your account manager can supply those details for your file.
Tempe's summer heat sets the service rhythm. The county standard is that tanks be emptied often enough to prevent overflow and insanitary conditions, with chemical held at a level that keeps odors down. A schedule that works in February rarely survives July without a second visit.
